Mangroves, Mean High Water and Shoreline Work

Do not trim, remove or build around mangroves based on a neighbor's project or a generalized online exemption summary.

Mangrove rules are specific

Florida's Mangrove Trimming and Preservation Act defines terms, exemptions and professional requirements. FDEP's official FAQ explains that eligibility can depend on the character and width of the mangrove fringe, ownership and proposed trimming. Construction and removal present additional questions beyond routine trimming.

Mean high water is not simply today's wet line

Legal and permitting boundaries use defined datums and surveys, not a single observation at high or low tide. A qualified survey may be needed to show existing and proposed work relative to the applicable boundary.

Questions before design

  • Are mangroves or other regulated resources within the work area?
  • Who is qualified to identify and document them?
  • Does the project add fill or extend waterward?
  • Is sovereign submerged land involved?
  • Can a living or hybrid approach reduce impact while meeting the protection goal?

Stop-work risk is preventable

Early resource and jurisdiction review is less expensive than redesign after clearing, mobilization or permit comments. Keep agency guidance and approvals in the property record.
